PUBLIKA INDONESIA.COM, BANJARMASIN – Terdakwa A (nama disamarkan) akhirnya bebas setelah Pengadilan Negeri (PN) Banjarmasin memutuskan dakwaan jaksa tidak terbukti dalam sidang putusan Selasa (22/4/2025).
Padahal, ia sebelumnya dituduh sebagai kurir 30 kilogram sabu dan ribuan pil ekstasi yang bisa berujung hukuman mati.
Sidang Online karena Terdakwa Idap TBC Akut
Terdakwa mengikuti sidang secara virtual dari ruang isolasi rumah sakit akibat kondisi TBC akut yang dideritanya.
Majelis hakim PN Banjarmasin, diketuai Irfanul Hakim, menyatakan terdakwa tidak terbukti secara sah dan meyakinkan melakukan tindak pidana narkotika.
Kurir Ojol yang Tak Tahu Isi Paket
Dalam pertimbangan putusan, hakim menyatakan:
- Tidak ada niat jahat (mens rea) – Terdakwa berprofesi sebagai kurir ojol dan hanya mendapat bayaran Rp200 ribu untuk mengantar paket dari Liang Anggang (Banjarbaru)
- Pola pengiriman sebelumnya berisi kosmetik – Pelaku DPO bernama Siska pernah memintanya mengantar paket berisi alat kecantikan yang diperiksa langsung oleh terdakwa
- Baru tahu isi narkoba saat digeledah polisi – Tidak ada bukti terdakwa mengetahui isi paket sebelum ditangkap
“Terdakwa hanya menjalankan pekerjaan sebagai kurir tanpa pengetahuan isi paket. Tidak ditemukan unsur kesengajaan,” tegas Hakim Irfanul.
Nasib Banding & Pelaku Utama Masih DPO
Kejaksaan Agung masih memiliki hak banding atas putusan ini. Sementara itu, Siska sebagai otak pengiriman narkoba masih berstatus buron (DPO).
